Terms & Conditions

LouisBernardPR.com
Effective from: August 26, 2026

These Terms and Conditions (the “Terms”) govern access to and use of louisbernardpr.com, including its pages, forms, portfolio, content, features, and related online services (collectively, the “Site”). The Site is operated by Louis Bernard, doing business as Louis Bernard Interior Design, a business established in Puerto Rico (“Louis Bernard,” “we,” “us,” or “our”).

1. Acceptance of These Terms

By accessing or using the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not access or use the Site. If you use the Site on behalf of a company, trust, partnership, or other entity, you represent that you have authority to bind that entity to these Terms.

2. Eligibility

You must be at least eighteen (18) years old and legally capable of entering into a binding agreement to use the Site or submit an inquiry. The Site is intended for lawful use by individuals and organizations interested in our services, portfolio, furnishings, décor, or properties.

3. About the Site

The Site presents information about interior design, commercial design, project coordination, furnishings and décor, and luxury real estate services. It may also display completed projects, concepts, materials, products, properties, testimonials, press features, and third-party content. Site content is provided for general informational, promotional, and inquiry purposes and may be changed, corrected, suspended, or removed at any time.

4. No Professional Relationship Created by Site Use

Viewing the Site, sending an email, submitting a form, requesting information, or participating in an initial conversation does not create a designer-client, broker-client, fiduciary, contractor, agency, or other professional relationship. A professional relationship begins only when the appropriate parties sign a separate written agreement that identifies the services, scope, fees, responsibilities, schedule, and other applicable terms.

5. Interior and Commercial Design Services

All interior design, commercial design, decorating, space planning, sourcing, procurement, project coordination, installation, styling, and related services are governed by a separate written proposal, engagement letter, design agreement, purchase order, or other contract. If these Terms conflict with a signed service agreement, the signed service agreement controls with respect to that engagement.

Portfolio images, design concepts, renderings, floor plans, color palettes, product suggestions, dimensions, budgets, timelines, and descriptions shown on the Site are illustrative. Every project is unique. Actual availability, specifications, costs, lead times, site conditions, permitting requirements, and final results may vary.

6. Luxury Real Estate Services

Real estate information on the Site is provided for general marketing and informational purposes only. It is not an appraisal, inspection, engineering opinion, legal opinion, tax advice, investment advice, financing commitment, or guarantee of value, condition, availability, zoning, permitted use, rental potential, or future performance.

Property descriptions, photographs, square footage, dimensions, prices, taxes, fees, amenities, availability, and other listing information may be supplied by owners, brokers, listing services, developers, or other third parties. Although we aim to present information accurately, it should be independently verified before any decision or transaction.

Any brokerage or real estate representation is subject to a separate written agreement and applicable licensing requirements. Real estate services are offered through Louis Bernard Interior Design, Puerto Rico license number 1486, and/or by Louis Bernard under license number V-4343, as applicable. Equal Housing Opportunity principles apply. Nothing on the Site is an offer where prohibited by law.

7. Contractors, Trades, Vendors, and Other Professionals

Projects may involve independent contractors, architects, engineers, installers, artisans, fabricators, vendors, real estate professionals, inspectors, lenders, attorneys, or other third parties. Their roles, selection, payment, supervision, warranties, and responsibilities will be defined in the applicable written agreement. Unless a signed agreement expressly states otherwise, third parties are independent providers and are responsible for their own work, licenses, insurance, personnel, safety practices, schedules, representations, and legal compliance.

A referral, recommendation, introduction, coordination effort, or appearance on the Site is not a guarantee of a third party’s performance. Clients should review credentials, licenses, insurance, references, proposals, and contract terms before retaining any third party.

8. Materials, Furnishings, Art, and Product Information

Materials, finishes, furnishings, lighting, accessories, art, and other products may vary from samples or photographs because of natural variation, production runs, screen settings, aging, installation, and lighting conditions. Availability, pricing, taxes, freight, delivery, lead times, warranties, and manufacturer specifications may change without notice.

If products are offered for purchase through the Site, the price, payment, shipping, delivery, return, cancellation, and warranty terms shown at checkout or in a separate posted policy will apply. Errors may be corrected and orders may be declined or canceled where permitted by law. Nothing in these Terms limits rights that cannot legally be waived under applicable consumer-protection law.

9. Estimates, Pricing, and Availability

Any preliminary budget, estimate, timeline, availability statement, or pricing information provided through the Site or an initial inquiry is non-binding unless incorporated into a signed written agreement. Taxes, permits, shipping, storage, delivery, installation, insurance, tariffs, site conditions, changes in scope, third-party charges, and other costs may affect the final price and schedule.

10. Appointments, Consultations, and Cancellations

Requests submitted through the Site are subject to availability and confirmation. An automated acknowledgment does not guarantee an appointment or acceptance of a project. Consultation fees, retainers, cancellation deadlines, rescheduling rules, refunds, and no-show charges, if any, will be disclosed before booking or in the applicable service agreement. See [CANCELLATION / REFUND POLICY URL, IF APPLICABLE].

11. User Inquiries and Submitted Materials

When you submit information through the Site, you agree that the information is accurate, current, lawful, and that you have the right to provide it. Do not submit confidential, proprietary, privileged, financial-account, government-identification, medical, or other highly sensitive information through a general contact form.

If you submit photographs, plans, drawings, measurements, inspiration images, property information, or other materials, you grant us a limited, non-exclusive right to use them solely to review and respond to your inquiry, evaluate a potential engagement, provide requested services, and maintain appropriate business records. You retain ownership of your materials. Public use in a portfolio, testimonial, advertising, or social media requires separate permission or a contractual right.

12. Acceptable Use

You may use the Site only for lawful personal or business purposes consistent with these Terms. You may not: copy, scrape, download, reproduce, republish, sell, license, or commercially exploit Site content without prior written permission; use automated systems, bots, crawlers, or data-mining tools except as expressly authorized by us or permitted by law; interfere with the Site’s security, operation, servers, networks, or other users; upload malicious code, attempt unauthorized access, impersonate another person, or submit false or misleading information; use Site content, images, designs, plans, or trademarks to train, develop, or operate an artificial intelligence or machine-learning system without written permission; or use the Site in a way that violates law, infringes rights, or exposes us or others to liability.

13. Intellectual Property

The Site and its original content, including text, photographs, project images, graphics, renderings, drawings, layouts, concepts, logos, trade names, videos, and overall design, are owned by or licensed to Louis Bernard and are protected by applicable copyright, trademark, and other intellectual-property laws. All rights are reserved.

We grant you a limited, revocable, non-exclusive, non-transferable license to access and view the Site for its intended purpose. No ownership rights are transferred. You may not use the name Louis Bernard, the domain louisbernardpr.com, any logo, or any project imagery in a manner that suggests endorsement, affiliation, authorship, or sponsorship without written permission.

14. Third-Party Content, Links, and Technology

The Site may contain links to or integrations with third-party websites, social networks, mapping tools, listing platforms, payment processors, scheduling services, suppliers, manufacturers, publications, and other services. The Site is hosted or supported by Wix and may use additional third-party technology. We do not control and are not responsible for third-party content, availability, security, accessibility, privacy practices, terms, products, or services. Your use of third-party services is governed by their own terms and policies.

15. Privacy and Cookies

Our collection and use of personal information are described in our Privacy Policy at [PRIVACY POLICY URL]. The Site may use cookies or similar technologies for essential functionality, analytics, security, preferences, and other purposes described in that policy or a cookie notice. By using the Site, you acknowledge that internet transmissions and electronic storage cannot be guaranteed to be completely secure.

16. Electronic Communications

When you contact us electronically or provide contact information, you consent to receive responsive communications and records electronically, subject to applicable law and your communication preferences. You agree that electronic notices and records may satisfy legal requirements that communications be in writing, where legally permitted. Marketing communications, if any, will include any opt-out method required by law.

17. Website Disclaimers

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, CURRENT, COMPLETE, OR SUITABLE FOR A PARTICULAR PURPOSE, OR THAT ANY DEFECT WILL BE CORRECTED.

DESIGN, CONSTRUCTION, MATERIAL, PRODUCT, AND REAL ESTATE OUTCOMES DEPEND ON FACTORS OUTSIDE THE SITE AND MAY REQUIRE SITE INSPECTION, PROFESSIONAL ANALYSIS, PERMITS, WRITTEN AGREEMENTS, AND INDEPENDENT VERIFICATION. SITE CONTENT SHOULD NOT BE USED AS A SUBSTITUTE FOR PROFESSIONAL ADVICE SPECIFIC TO YOUR PROJECT OR TRANSACTION.

18. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, LOUIS BERNARD AND ITS OWNERS, OFFICERS, EMPLOYEES, REPRESENTATIVES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR LOSS OF DATA, REVENUE, PROFITS, BUSINESS OPPORTUNITY, OR GOODWILL, ARISING FROM OR RELATED TO THE SITE OR RELIANCE ON SITE CONTENT.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY FOR CLAIMS ARISING SOLELY FROM USE OF THE SITE WILL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS (US $100) OR THE AMOUNT YOU PAID DIRECTLY TO US FOR ACCESS TO THE SITE DURING THE SIX MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. THIS LIMIT DOES NOT APPLY TO LIABILITY THAT CANNOT LAWFULLY BE LIMITED, INCLUDING LIABILITY ARISING FROM FRAUD, INTENTIONAL MISCONDUCT, GROSS NEGLIGENCE, OR OTHER NON-WAIVABLE RIGHTS OR REMEDIES.

Claims relating to paid professional services, products, purchases, or real estate representation are governed by the applicable signed agreement and mandatory law, not solely by this Section.

19. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Louis Bernard and its owners, officers, employees, representatives, and service providers from claims, damages, losses, liabilities, and reasonable costs arising from your unlawful use of the Site, your violation of these Terms, your infringement of another person’s rights, or materials you submit without authorization. This obligation does not apply to the extent a claim results from our own wrongful conduct or where indemnification is prohibited by law.

20. Suspension and Termination

We may restrict, suspend, or terminate access to the Site, remove submitted content, or take protective measures if we reasonably believe that a user has violated these Terms, threatened the Site or another person, engaged in fraud or unlawful conduct, or created legal or security risk. Provisions that by their nature should survive termination will remain in effect, including intellectual-property, disclaimer, liability, indemnification, and governing-law provisions.

21. Changes to the Site or These Terms

We may update the Site and these Terms from time to time. The revised Terms will be posted with a new effective date. Changes apply prospectively from the stated effective date unless law requires otherwise. Your continued use of the Site after revised Terms become effective constitutes acceptance of those revised Terms. Material changes may also be communicated by another reasonable method when appropriate.

22. Governing Law and Venue

These Terms are governed by the laws of the Commonwealth of Puerto Rico and applicable federal law, without regard to conflict-of-law principles. Subject to any mandatory consumer-protection or venue right that cannot be waived, disputes arising from these Terms or the Site will be brought in the courts of competent jurisdiction located in Puerto Rico, and the parties consent to those courts’ jurisdiction. Nothing in these Terms prevents either party from seeking emergency or injunctive relief where legally available.

23. Puerto Rico Consumer Rights

Nothing in these Terms waives or limits rights, warranties, remedies, disclosures, or protections that cannot be waived under Puerto Rico or federal law. If a provision conflicts with a mandatory law, the mandatory law controls and the remaining provisions will continue to apply to the fullest extent permitted.

24. Language

These Terms may be made available in English and Spanish for convenience. Unless applicable law requires otherwise, the English version will control in the event of a conflict or inconsistency. Any published Spanish translation should be reviewed for legal accuracy before use.

25. Miscellaneous

These Terms, together with the Privacy Policy and any other policies expressly incorporated by reference, constitute the entire agreement regarding use of the Site. They do not replace a signed design, procurement, construction, product, or real estate agreement. If any provision is held invalid or unenforceable, it will be modified or limited to the minimum extent necessary and the remaining provisions will remain effective. Our failure to enforce a provision is not a waiver. You may not assign your rights under these Terms without our written consent; we may assign these Terms as part of a reorganization, sale, transfer, or other lawful business transaction.
